***Mumia Hearing Cancelled, Stay Tuned for Update on Action of Feb.
11th!************

Ona MOVE!
Judge Pamela Dembe cancelled
Mumia’s scheduled Feb. 11th court hearing.
Her reasoning was explained by Mumia’s attorney, Robert Bryant:
„Judge Pamela Dembe, Court of Common Pleas, Philadelphia, has ordered
briefing by February 15 on the issue of whether the Pennsylvania Supreme
Court’s recent decision in /Commonwealth v. Johnson/, 2004 Pa. LEXIS
3118, „speaks to the jurisdiction of the Court to proceed in defendant’s
third PCRA petition.“ This is disturbing since the court’s preliminary
interpretation of the /Johnson/ case appears to be wrong, for it does
not prevent her from granting us a hearing on two issues of great
significance relating to the unfairness of the trial. There is no new
law in /Johnson/, rather it is just the application of long-established
law to the facts of Mumia’s case.“
.
Legally, cancelling a hearing at this late date is not the norm, but
Mumia’s case has consistently been subject to rule bending against him.
Dembe should be pressured to do right by Mumia.

But despite Judge Dembe’s absurd cancellation of Mumia’s hearing, the
February 11th demonstration will go on as earlier planned. Dembe’s
action is consistent with all the fraud, lies, deceit, and
irregularities marring Mumia’s case. The courts have attempted to stunt
the people’s power on behalf of Mumia by cancelling at the eleventh
hour, letting people lose their plane ticket funds, bus fares, and stop
our momentum. However, protesting now is relevant and urgent– we need
to be present, visible, and vocal in our demands that Mumia’s hearing be
reinstated, with him present, to let the evidence be heard, and
ultimately to RELEASE MUMIA!
.
Each day, each hour, call Dembe and add your voice to the chorus. She is
currently feeling the collective heat of her colleagues in the FOP,
D.A.’s office, governor’s mansion, and on upto the top. To see Mumia
walk out free from SCI-Greene we need to make our people’s pressure
greater than what she is experiencing from the other side. There is only
one way to do that– JOIN TOGETHER!
.
We demand that Judge Dembe let the truth be heard. Call her to demand
that Mumia’s hearing be reinstated, with him present, and the evidence
be heard so that Mumia will be released!

I am pleased to announce that on January 11, 2005 the San Francisco Board
of Supervisors, in a 9-2 vote, approved a strong resolution supporting
justice for Mumia Abu-Jamal. The resolution proceeded through a series of
technical hurdles, including a formal posting, a public hearing at which
three members of the Mobilization to Free Mumia Abu-Jamal spoke and
finally, a full meeting of the San Francisco Board of Supervisors.

The resolution will be formally printed by the City of San Francisco and
delivered to us with the city’s formal seal.

In solidarity,

Jeff Mackler
Mobilization to Free Mumia Abu-Jamal

JUSTICE FOR MUMIA ABU-JAMAL

Resolution approved by the San Francisco Board of Supervisors
January 11, 2005

Whereas, Mumia Abu-Jamal, an award-winning African-American journalist,
author of nine books and internationally known social critic and opponent
of the death penalty, has been on Pennsylvania’s death row for the past 22
years, and,

Whereas, Amnesty International has pointed to serious flaws in the conduct
of his 1982 trial that raise critical constitutional issues that demand a
new trial for Mr. Jamal, and,

Whereas, among the issues that Amnesty International raised are:
suppression of critical evidence pointing to Mr. Jamal’s innocence, the
illegal exclusion of African-American jurors, the denial of the right to
self-representation and the intimidation of witnesses, and,

Whereas, prominent organizations including the California Labor Federation,
AFL-CIO, the Episcopal Church of the United States, the National
Association for the Advancement of Colored People (NAACP), the European
Parliament, the San Francisco Labor Council, the Detroit City Council, the
National Lawyers Guild, the ILWU, AFSCME and SEIU national unions and many
others, have called for justice and a new trial for Mr. Jamal, and,

Whereas, San Francisco’s former Mayor Willie Lewis Brown, Jr. declared
August 16, 1997 as „Justice for Mumia Abu-Jamal Day in San Francisco.“

Therefore, Be It Resolved that the San Francisco Board of Supervisors
affirm its support for justice and a new trial for Mumia Abu-Jamal, and,

Be It Further Resolved that this resolution be communicated to the
Governor’s office of the State of Pennsylvania for his information.
